1.1 Security and Account Protection
The customer is fully responsible for maintaining the confidentiality of their account credentials and is responsible for all activities conducted through their account.
The customer agrees to notify OurSMS immediately in the event of:
- Loss or theft of account credentials.
- Unauthorized access to the account.
- Any suspected security incident affecting the account.
OurSMS will take reasonable measures to help mitigate potential damage once notified.
1.2 Third-Party Services
The application or website may contain links to third-party services, including but not limited to WhatsApp, Meta, payment gateways, and other external platforms.
These services operate under their own privacy policies and terms of use. OurSMS is not responsible for the content, policies, or practices of third-party services.
Users are encouraged to review the privacy policies and terms of any third-party services before using them.
1.3 Account Requirements
To use the service, the user agrees that:
- The user must be at least 16 years old.
- All information provided must be accurate and up to date.
- The user is responsible for protecting their account password and credentials.
- The service must not be used for unlawful activities.
- Any violation of applicable laws, regulations, or platform policies may result in immediate suspension or termination of the account.
1.4 Account Ownership and Activation
- The contracting party is considered the owner of the account and is solely authorized to manage the account and any associated sub-accounts.
- If an individual subscribes to the service on behalf of an employer or organization, the employer or organization shall be considered the account owner, and both parties are bound by these terms.
1.5 Payments
- OurSMS provides pricing information for services before and after subscription.
- Users are responsible for reviewing and understanding the current service pricing.
- Payment may be made through bank transfers, credit cards, or other approved payment methods.
- Users authorize the relevant payment provider to process payments for subscribed services.
- Users are responsible for paying all fees on time and acknowledge that they have reviewed the applicable cancellation and refund policies.
1.6 Commitments and Warranties
OurSMS Responsibilities
OurSMS is responsible for:
- Providing technical support.
- Maintaining the platform infrastructure.
- Operating and managing the service environment.
User Responsibilities
The user agrees to:
- Comply with all applicable laws and regulations in Saudi Arabia and other relevant jurisdictions.
- Use the service only for lawful business purposes.
- Avoid any activity that may harm, disrupt, abuse, or interfere with the platform or its services.
WhatsApp Business API Terms
The WhatsApp Business API service provided through OurSMS relies on services operated by WhatsApp and Meta.
By using WhatsApp services directly or indirectly through OurSMS, the user acknowledges and agrees that:
- The user is subject to all applicable WhatsApp and Meta policies, terms, and guidelines.
- OurSMS has no control over decisions made by WhatsApp or Meta.
- The user is solely responsible for complying with WhatsApp Business policies.
- The user is solely responsible for the content of messages sent through WhatsApp.
- The user is solely responsible for how WhatsApp is used within their business.

OurSMS is an independent service provider and is not owned, operated, or controlled by WhatsApp or Meta.
WhatsApp Number Suspension Disclaimer
OurSMS operates in accordance with WhatsApp Business and Meta policies and does not provide services intended to violate those policies.
However, the user acknowledges and agrees that:
- Any suspension, restriction, limitation, or ban imposed on a WhatsApp number, whether temporary or permanent, is the responsibility of the user and may result from policy violations, messaging behavior, content, or business practices.
- OurSMS is not responsible for any WhatsApp account suspension, restriction, or termination imposed by Meta or WhatsApp.
- OurSMS does not guarantee that a WhatsApp number will remain active indefinitely.
- OurSMS has no control over decisions made by WhatsApp or Meta regarding account reviews, restrictions, or bans.
In the event of a suspension:
- OurSMS may assist the user in submitting an appeal or attempting reactivation where possible.
- OurSMS is under no obligation to provide a replacement number, alternative account, refund, or compensation.
The user remains fully responsible for:
- Compliance with WhatsApp policies.
- Proper use of message templates.
- The nature of their business activities.
- Communication practices with customers.
No financial compensation shall be due from OurSMS for any suspension, restriction, or loss of access resulting from actions taken by WhatsApp or Meta.
